• Shoot "As-Is" & Minor Adjustments: We photograph the property exactly as it is presented upon our arrival. At the photographer's discretion, we may make minor aesthetic adjustments for the camera (e.g., closing toilet seats, adjusting towels, or temporarily hiding small countertop items). However, the agent or homeowner is entirely responsible for ensuring the property is fully prepped, cleaned, and decluttered prior to the scheduled shoot time.


• Protecting Your Space & Heavy Lifting: For safety and liability reasons, our photographers will not clean rooms, move heavy furniture, handle high-value/fragile items, or clear construction debris. 918 Dream Shots is not liable for any claims of property damage related to moving or altering items within the home.


• Safeguarding Fragile Items: While we take the utmost care and respect while navigating a property, photography requires moving professional equipment through tight spaces. The agent and homeowner are exclusively responsible for securing, removing, or safely storing all fragile, wobbly, or highly valuable items prior to the shoot.


• Pets & Hazards: All pets must be contained or removed from the property during the shoot. If a property is deemed hazardous or unsafe to enter upon arrival, the shoot will be canceled and the agent will be responsible for a rescheduling fee.

• Next-Day Turnaround (Photography): We know speed is critical for your listing. Our standard operating procedure is to provide a quick next-day turnaround for all standard photography and floor plans following the completion of your shoot.


• Advanced Media (Video, 3D Tours, & Virtual Staging): Premium add-ons require additional processing, rendering, and editing time. Cinematic videos, 3D tours, and advanced edits typically require a 48 to 72-hour turnaround.


• Unforeseen Circumstances: While we pride ourselves on speed and reliability, life and technology can be unpredictable. Unforeseen circumstances (such as software or internet outages, equipment malfunctions, human error, or personal illness) can occasionally cause processing delays.


• Grace Period & Liability: In the rare event of a delay, 918 Dream Shots will communicate with you immediately and make delivering your gallery our top priority. We are not financially or legally liable for delayed deliveries, nor do we cover any resulting damages or losses including, but not limited to: lost agent expenses, marketing costs, or missed commissions.

• 918 Dream Shots retains full copyright ownership of all media produced. Your payment grants you an indefinite, non-exclusive license to use the media for marketing this specific property and your own professional brand.


• Your Usage Rights: This license is valid indefinitely for the original purchasing agent. You are welcome to use the media for the active listing, "Just Sold" campaigns, social media, and your personal professional portfolio.


• Collaborative Marketing: Your license fully covers sharing these photos with your colleagues, brokerages, and wider network to help market and sell the property.


• Third-Party Businesses (Not Allowed): The media cannot be gifted, sold, or transferred to outside commercial vendors (such as stagers, contractors, or other builders) or to homeowners for short-term rental use (Airbnb/VRBO). Outside vendors who wish to use the photos for their own marketing must contact 918 Dream Shots directly to purchase a commercial license.


• Re-Listing: If the listing expires and a different agent takes over the property, they must purchase a new license from 918 Dream Shots to legally use the media.

• Pilot Authority: All flights are conducted strictly under FAA Part 107 regulations. The drone Pilot-in-Command (PIC) has final and absolute authority on all flight decisions regarding weather, airspace, safety, and legality.


• Airspace Restrictions: If a property is located in restricted airspace (Zero-Grid zone, near an airport, or active TFR) where FAA authorization cannot be legally obtained, drone services will not be performed.


• Weather, Visibility, & Rescheduling: By federal law, drones cannot be flown if visibility is below 3 statute miles. Furthermore, for equipment safety, we do not fly in fog, active rain, sustained winds exceeding 20 mph, or any other conditions the PIC deems unsafe.
  
• Grounded Drone Protocol: If weather or airspace restrictions prevent us from safely capturing your scheduled aerials (via package, land shoot, or add-on), we will either: 1) Provide a fair invoice credit for the drone portion of your shoot, 2) Swap the drone value for a premium editing add-on (like Virtual Twilights), or 3) Make every effort to return and shoot the aerials at the earliest available weather window.


• "Blue Sky" Guarantee: Oklahoma weather is unpredictable. If it is cloudy or overcast during your scheduled shoot, we provide our Blue Sky Guarantee: Blue sky replacement on all exterior photos at absolutely zero additional cost.

• Payment to Download: All media is delivered via a secure online gallery. Payment in full is required before high-resolution files and media links can be downloaded or utilized.

• Marketing Provider, Not a Guarantee: 918 Dream Shots provides premium media to assist in marketing. We are not legally or financially responsible for the sale of the home, the final sale price, or days on the market.


• Financial Cap: Under no circumstances will 918 Dream Shots be held liable in any way for indirect, incidental, or consequential damages. This includes, but is not limited to: missed deadlines, lost real estate commissions, expired contracts, or expenses incurred due to property unreadiness.


• Maximum Liability: In the highly unlikely event of total equipment failure, data loss, or inability to deliver the agreed-upon media, our maximum legal and financial liability is strictly capped at a refund of the exact amount paid for the service.
